Kate Wyatt is a trial attorney who handles companies’ toxic tort litigation, products liability litigation, construction defect litigation, premises litigation, and business litigation in state and federal courts. Kate prides herself on representing companies that range from Fortune 100 to small family-owned companies.

Kate has defended toxic tort premises liability and products liability actions, serving on both local and national counsel teams. Kate has been part of national counsel teams involving all aspects of the discovery process and trial preparation in both state and federal courts in a multitude of jurisdictions. In that capacity, she has worked to craft a nationwide defense, streamline the discovery process, and has prepared lay witnesses, corporate witnesses, and expert witnesses, including medical experts, industrial hygienists, and intellectual property experts.

Kate has represented toxic tort and asbestos defendants in state and federal court, and worked as part of defendants’ liaison counsel team in Massachusetts asbestos litigation. She has defended asbestos claims involving both premises and products, including refineries, chemical plants, shipyards, oil fields, boilers, brakes and other automobile components, paints and pigments, resins, asphalt, and pipes. In addition, Kate has defended wrongful death actions relating to industrial accidents, including construction sites, and has worked to prepare safety and OSHA compliance experts.

Kate also routinely defends cases brought against construction companies, contractors, building products manufacturers, suppliers, engineers, and architects involving both commercial and residential properties. Her experience includes defending construction defect cases involving water intrusion, mold, drainage issues, roofing defects, and structural problems. Kate has also defended fire and explosion cases.

Kate has also worked extensively to build protocols and procedures for both large and small companies to comply with the Medicare Secondary Payer Act, Medicaid Secondary Payer procedures and Medicare, Medicaid and SCHIP Extension Act of 2007 (MMSEA/ Mandatory Settlement Reporting).

Kate has been selected by her peers for inclusion as a New England Super Lawyers “Rising Star” and in Best Lawyers: Ones to Watch.
